Terms of Service

1. Service Description

SparkServe provides dedicated LLM inference API access powered by NVIDIA GB10 Grace Blackwell hardware. The service is operated by Nakamu-Tech Inc. and is currently available as an Early Access offering.

2. Eligibility

You must be at least 18 years old and have the legal capacity to enter into a binding agreement to use SparkServe.

3. Account & Access

Access is granted on an invitation basis during the Early Access period. You are responsible for keeping your API key confidential. Do not share your credentials with unauthorized parties.

5. Pricing & Billing

Pricing is as listed on our website at the time of your subscription. Plans are billed monthly. We reserve the right to adjust pricing with 30 days' notice. There are no refunds for partial months, but you may cancel at any time.

6. Service Availability

We aim to provide reliable service but do not guarantee 100% uptime during the Early Access period. Scheduled maintenance will be communicated in advance. Enterprise plans include SLA commitments as specified in separate agreements.

7. Data & Privacy

Your inference data (prompts, responses) is processed on your dedicated instance and is not stored, logged, or used for model training. See our Privacy Policy for details on personal data handling.

8. Intellectual Property

You retain all rights to the content you generate through the API. SparkServe and its logo are trademarks of Nakamu-Tech Inc. NVIDIA, Blackwell, and GB10 are trademarks of NVIDIA Corporation.

9. Limitation of Liability

SparkServe is provided "as is" during Early Access. To the maximum extent permitted by law, Nakamu-Tech Inc. shall not be liable for any indirect, incidental, or consequential damages arising from the use of the service.

10. Termination

Either party may terminate the service at any time. We reserve the right to suspend accounts that violate these terms. Upon termination, your API access will be revoked and any remaining balance will be refunded on a pro-rata basis.

11. Governing Law

These terms are governed by the laws of the State of Texas, United States.

12. Changes

We may update these terms from time to time. Material changes will be communicated via email. Continued use of the service constitutes acceptance of updated terms.
